MK: Members of the TNI-Police Have No Right to Choose Presidential Election

The Constitutional Court granted the judicial review related to the gap in legal uncertainty regarding suffrage members of the military and police in elections . The court verdict ensure that members of the TNI / police do not have the right to vote in presidential elections on July 9 .

In its discretion , the court argued , military / police need to continue to maintain its neutrality in the functions and duties as a state authority . Neutrality of the TNI / Police , said Hamdan , with no use of her right to choose .

The case stated in the minutes of the trial numbers 22/PUU-XII/2014 . Test material was filed by two petitioners , former Chairman of the National Commission on Human Rights Ifdhal Kasim and advocate Supriyadi Widodo Eddyono .

The applicant filed a judicial review of Article 260 of Law Number 42 Year 2008 concerning the election of President and Vice President . According to the applicant 's attorney Wahyudi Djafar , the article is different settings by Article 326 of Law No. 8 of 2012 on the Election of DPR , DPD and DPRD .

Wahyudi said the different settings that give rise to a situation of legal uncertainty . On the one hand , in the context of the legislative elections , the right of members of the military / police is limited , but the presidential election , there is no ban on the use of political rights that can be interpreted by members of the TNI / police can exercise their voting rights .
